Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the Prospectio.io platform and services. It is incorporated by reference into our Terms of Service. Violation of this AUP may result in warning, suspension, or termination of your account.

1. Prohibited Activities

You may not use the Service to:

1.1 Spam and Unsolicited Communications

• Send spam or unsolicited bulk email without a lawful basis under applicable anti-spam legislation (CAN-SPAM, CASL, GDPR, etc.)
• Upload purchased lists of personal (non-business) email addresses for cold outreach
• Send commercial email to individuals who have previously opted out or unsubscribed
• Use deceptive subject lines, false headers, or misleading sender information

1.2 Identity Misrepresentation

• Misrepresent your identity, company, or affiliation in outreach communications
• Impersonate another person or organization
• Use false or misleading information in your account profile

1.3 Illegal and Harmful Content

• Send, upload, or distribute content that is illegal, defamatory, obscene, threatening, or that violates the rights of others
• Use the Service in connection with any fraudulent, deceptive, or misleading activity
• Promote or facilitate illegal activities, including phishing, malware distribution, or financial fraud

1.4 Platform Abuse

• Attempt to circumvent rate limits, usage quotas, or other platform restrictions
• Interfere with the operation, integrity, or performance of the Service or its underlying infrastructure
• Probe, scan, or test the vulnerability of the Service without authorization
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated tools (scrapers, bots) to access the Service except through our documented API

1.5 Account Security

• Share your account credentials with unauthorized individuals
• Allow multiple individuals to use a single account (each user must have their own account)
• Access or attempt to access another user's account or data without authorization

1.6 Harassment and Abuse

• Use the Service to harass, threaten, intimidate, or abuse any individual
• Send repeated unwanted communications to individuals who have asked you to stop
• Use the Service to stalk or monitor individuals without their knowledge or consent

2. Cold Email Requirements

When using Prospectio for cold email outreach, you must at all times:

1. Have a legal basis for contacting each lead (such as legitimate interest for B2B communications)
2. Include a clear and functioning unsubscribe mechanism in every outreach email
3. Honor unsubscribe requests within 10 business days (the platform processes these automatically)
4. Include a valid physical postal address in your email communications as required by CAN-SPAM
5. Clearly identify the sender and purpose of the communication
6. Comply with all applicable anti-spam laws in both your jurisdiction and the jurisdiction of your recipients

3. Data Handling

You are responsible for:

• Ensuring that the personal data you upload to the platform was collected lawfully
• Maintaining appropriate records of your legal basis for processing lead data
• Responding to data subject access, rectification, and erasure requests related to the lead data you control
• Not uploading sensitive personal data (health information, financial account numbers, government IDs, etc.) to the platform

4. Reporting Violations

If you become aware of any violation of this AUP by another user, please report it to contact@prospectio.io. We take all reports seriously and will investigate promptly.

5. Enforcement

Prospectio enforces this AUP through a graduated response process:

1. Warning: For first-time or minor violations, we will notify you of the issue and request corrective action
2. Suspension: For repeated or serious violations, we may temporarily suspend your access to the Service while the matter is resolved
3. Termination: For severe or persistent violations, we may permanently terminate your account. In cases of egregious abuse, termination may occur without prior warning

We reserve the right to remove content or restrict functionality at any time if we reasonably believe a violation has occurred. Decisions regarding enforcement are made at our sole discretion.

6. Changes to This Policy

We may update this AUP from time to time. Material changes will be communicated via email and in-app notification at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised AUP.
